Abstract:
The article deals with the problems of participation of persons sentenced to imprisonment in civil law turnover. Convicted persons in detention retain their legal status and have the right to freely exercise civil rights and participate in civil turnover. However, the analysis of the legislation of the Russian Federation allows to draw a conclusion about existence of gaps in the normative legal acts regulating questions of Commission of notarial actions in imprisonment places concerning the persons serving punishment. The article deals with the disclosure of notarial secrecy, which entails not only the violation of the rights of the convicted person and as a result does not allow to provide adequate protection of the subjective right of the convicted person in case of its violation, but also affects the rights of third parties who are not in detention.
