Abstract:
In the article the problems of implementation of penal purpose when applied to convicted persons punishment of imprisonment, given the critical analysis of the differentiation of crimes categorized gravity, identified gaps criminal procedural law in the implementation of the principles of justice and humanity, and the election of a sentence of imprisonment. Established criteria for determining the priority of the social danger of the act and the crime category. Proposed changes in criminal, criminal procedure and criminal-executive legislation for the sound application of the penalty of imprisonment.
