Abstract:
In presented article the author gives critical analysis of the current state of criminal legislation which establishing in the list of punishments (article 44 of the Criminal Code of the Russian Federation) three similar in essence penalties with different terminological names: mandatory work, corrective labour and a new type of punishment - forced labor. The relevance of the research is associated with the creation of an imbalance within the system of punishments and beyond, as well as the mismatch of legal rules, which governing these types of sentences. The author makes proposals for perfecting of the Criminal code of the Russian Federation and elimination the imbalance of rules of criminal legislation in this part.
