Abstract:
At the micro level functional legal comparison considers questions of the reasons of a concrete design of the law and its function. A subject of micro comparison are specific individual problems, separate legal institutes and norms, resolution of conflict of interests in various jurisdictions. The center of attention of this comparison at the same time are variable comparisons. They are divided into an explanatory dependent variable (the law as Explainable) and explanatory independent variables (the law as Explaining). In case of a research of provision on protection of tenants/employers in Germany, different rules of protection would be an independent variable while various standards of the Civil code could be used as dependent variables in Russia. Any transformation of the legislation in the Russian Federation cannot do without studying of international experience. Comprehension of a foreign law always gave the importance to comparative and legal researches.
