Abstract:

The analysis of legal norm containing in the Art.234 of the Labor Code of the RF regulating the material obligation of an employer in the cases of illegal deprivation of an employee to work is considered in the article, there was determined that its small list of such cases is comprehensive and has an closed character. It is in great extent limits the sphere of action provided in the first paragraph of the given norm of the rule on obligations of an employer to compensate to an employee not received earnings in all cases of deprivation to work, in the result of it there was excluded the possibility to compensate these earnings in cases which are absent in the cases which are can be used in practice. The present contradiction between structural subdivisions of researched norms indicates to imperfection of its structure, it leads to liberation of an employer from material obligation in these cases. All it faces the legislator the possibility of reconstruction of the present norm structure in connection with it the author makes an offer promoting the decision of this task
