Legal regulation of an employee’s transfer to a permanent job to another employer

At present article the object of the research is labor relationships on an employee’s transfer to a permanent job to another employer which are regulated by the part 2 Art. 72.1 LC RF. The subject of the present work includes the questions connected with: historical development of labor legislation mediating the present type of transfer to another job, legal concept of an employee’s transfer to another organization, order of implementation of this transfer. When analyzed the opinion of scientists supporting the approach of the legislator to the concept of transfer to another job and as well as there were examined the views of experts in the field of labor law that do not recognize the transfer to another job the transition of an employee to another organization, as, in their opinion, in this case there is no change of the employment contract and its termination. Not agreeing with these researchers, the authors provide the detailed and reasonable arguments of their position. In addition, there was criticized the existing concept in labor law, according to which the employee’s transfer to another employer is recognized the obsolete category which is not agreed are with the doctrine of labor law. The main conclusions of the carried out analysis are the following: admission of an employee’s transfer to another employer by independent type of a transfer to another job, it gives the foundation to include it in the notion of transfer containing in part 1 Art. 72.1 LC RF; consideration of joint act of will (agreement), based on mutual expression of will of three subjects, contract labor establishing the conditions for transition of an employee to another organization. The special contribution of the authors in the study of the problem is the introduction of a number of specific proposals aimed at improving the labor legislation governing the transfer of an employee to a permanent job for another employer, which will contribute to strengthening the legal mechanism of protection of labor rights and legitimate interests of employees in their transfer to another organization.
