FINANCIAL RESPONSIBILITY OF AN EMPLOYER FOR DAMAGE INFLICTION TO AN EMPLOYEE USED IN INTERESTS OF AN ORGANIZATION

The aim of the present research is to consider the theoretical problems connected with legal regulation of financial regulation of an employer for damage infliction to an employee used in a production process as it was set in the Article 188 of the LC of the RF. To achieve this goal the author puts the following tasks: to reveal the connection of the employee’s property provided for in this Article, with the category «employee’s property» due to the Article 235 of the LC of the RF; to determine the legal regime of the property which the employee with the consent of the employer can legally use it in his interests under implementation of his labor responsibilities conditioned by the labor agreement; to work out the offers to improve the labor legislation regulated the relations of financial responsibility of the employer for damage inflicted to the property of the employee indicated in the Article 188 of the LC of the RF. The necessity to solve the present tasks caused the need to apply such methods of scientific cognition as general (analysis, synthesis, analog, generalization, classification) as and specially - legal (comparative-legal, legal-technological). Scientific novelty of the article is that it is a first research specially devoted to the problems of financial responsibility of the employer for damage infliction to the employee’s property indicated in the Article 188 of the LC of the RF. The special contribution in study of such type of labor-legal responsibility is to admit the offer of the author to reconstruct of the Article 188 of the LC of the RF, it increases the effectiveness of the legal mechanism of protection of labor rights of employees. The present article can present the interest for scientific employees, employers, legal advisers, human resource employees and other practical employees and as well as can be used in academic process by lecturers, post-graduates, graduates and students of legal higher schools and faculties.
