CONCEPT OF THE EMPLOYEE OF LAW ENFORCEMENT AGENCY OF THE RUSSIAN CRIMINAL LEGISLATION

The reform of law enforcement agencies and change the criminal legislation of the Russian Federation prompted the writing of this work. The survey reveals the need to establish the status of the law enforcement officer for the correct qualification of acts of punishment, for the implementation of measures of criminal-legal protection of law enforcement officers from criminal encroachments and other issues of criminal law. The introduction of a number of new norms in the criminal code of the Russian Federation provides the prerequisites for the further development of the concept of the law enforcement officer in criminal law. This raises the need to define the circle of bodies of state power, which will give the person signs a special subject of the crime or the characteristics of the additional (double) of the object of abuse. We have investigated the existing approaches to the definition of the law enforcement officer, conducted delimitation of law enforcement bodies from other bodies, organizations and institutions. The analysis appeared in the criminal code of the Russian Federation of new standards and examines the prerequisites for further development of the concept of the law enforcement officer in criminal law. This study allows us to rethink the role of law enforcement officials in society. The research results can be taken into account for the unification of the status of law enforcement officers from different agencies, and further development of the system of measures of criminal-legal protection, as well as a system of norms of increased responsibility. This is a prerequisite for the development of criminal law in this area.
