Abstract:
It is shown the mechanism of abuse law in the article, which is based on inquiries of judicial practice the author has created. It is stated that determination of mechanism of abuse has law evidentiary value for the trial in each individual case. It let us set what the «intricate» scheme of actions selected by individual for realization their unfair intentions. Author applied the general scientific and particular scientific methods in examination, in specially a formal-legal method. They have allowed considering of a versatile and integrality the subject of research. In the result of research the conclusion was drawn. Determined that as means of law abuse are law and legal conditions (active and passive) where provisions of legal are simultaneously the source of abuse. Also explained the mechanism of abuse law. Determined its elements. In the conclusion the author makes an inference that mechanism of abuse of phenomenon of the implementation by law for evil needs to be clarified. It is standard should be designated in the law.
