Abstract:

Age-specific criminal insanity is researched by Russian and foreign scientists. Though the ambiguity of legislative regulation of this legal institution demands additional examination. The analysis of age-specific criminal insanity is reinforced by investigation of respective legislation. The proper specification of age-specific criminal insanity lies in adhering to such principles as principle of guilt and justice. The author supposes that fulfillment of those principles is possible as a result of more detailed analysis of intellectual, emotional and conative components of criminal sanity. The present research`s conclusions claim the necessity of readjustment of the legislation which regulates the age-specific criminal insanity so that the norms of this legislation are construed and used unambiguously.
