Abstract:
Objective: a Large number identified by the traffic police of the MIA of Russia of the crimes referred to in article 264.1 of the criminal code of the Russian Federation has determined the need for detailed analysis of activity on the attraction of persons to criminal responsibility under this article for practical recommendations that will allow for this area as efficiently as possible. Model: the Article is devoted to topical problems arising in activities of the traffic police of the MIA of Russia in the detection of crimes, as stipulated in article 264.1 of the criminal code. It discussed in detail the algorithm of actions of employees of traffic police of the MIA of Russia in the identification of persons operating vehicles in a state of intoxication, previously brought to criminal or administrative liability for the same offense. Conclusions: the article proposes the optimal variant of work of employees of the traffic police of the MIA of Russia in the detection of crimes, as stipulated in article 264.1 of the criminal code and clarifies certain administrative aspects relating to identification of persons operating vehicles while intoxicated. Practical value: the paper is focused on employees of traffic police of the MIA of Russia exercising the state function on implementation of Federal state supervision of observance by participants of traffic of requirements of the legislation of the Russian Federation in the field of road safety.
