THE RIGHTS AND INTERESTS IN CIVIL PROCESS

The Russian legislation guarantees everyone protection of the rights and interests. The terms of "rights" and "legitimate interests" are fixed in the text of legal acts. It is necessary at the same time to differentiate more accurately, if it concerns the rights or legitimate interests. There isn't developed the general opinion on this problem in the legal doctrine. An author set a question of the application of categories of "rights" and "legitimate interests" in the article. The analyzed jurisprudence helps studying of these concepts because the judicial authority has a crucial role in the state protection of the rights and interests of the person and the citizen.
