Abstract:
Introduction: the article considers the current problems of legal science. Objective: to determine the role of punishment in the legal institution of legal responsibility. Objectives: to examine the major theoretical and legal aspects of punishment in systemic legal liability. Methods: the methodological basis of punishment, as a form of legal responsibility, is a dialectical approach to the study of social reality. Conclusions: the institution of punishment is a form of legal liability, executed on behalf of the public authority in ensuring strict coercion in the form of punishment for the committed criminal act to restore social justice. According to the author, upon appointment by the court of punishment as a tool of legal liability, and establishes the following are state and legal goals of protecting the rights of an uncertain circle of persons, the prevention of crime and the restoration of social justice.
