Abstract:
The present article is dedicated to the issues arising in relation to the procedural aspects of the dismissal reduction. The article are considered norms of abuse of court jurisdiction, wrong interpretation of the provisions of the legislation on the concept of job openings and pre-emption right to leaving at work. The author is analyzed judicial and law enforcement practice. Particular attention is paid to the legal position of the higher courts.
