Abstract:
Information and telecommunication network Internet became an essential part of peoples’ lives. Anonymity and uncontrolled access to the network led to infringements of copyright and neighbouring rights in the Internet. Given the current situation the liability allocation among a direct offender and a provider is of great importance. Due to the cross-border nature the subject has been analyzed by the scientific community all around the world. Lawrence Lessing, Gram Greenleaf, Darrel Menthe and other scholars were scrutinizing the issue in their writings. The conducted research proves the creation of the unified international approach to law enforcement regarding the issue. The common law countries limit a provider’s liability assuming his cooperation with a copyright owner and assistance in the extinction of offences. The article consolidates law enforcement experience of common law countries regarding the issue, emphasizes weak points and offers improvements.
