CONFLICT REGULATION OF THE SECURITY REAL RIGHTS

In this article are analyzed questions of conflict regulation of the security real rights in the relation of a personal estate, a problem of the foreign limited real rights action for Russia territories. The purpose is to cover problems of functioning of the adaptation mechanism of the foreign security real right for application in the Russia territory in accordance to Russian law. The sources of research were the publications of Russian and foreign scientists in limited real rights, a law of conflict, comparative jurisprudence. There is investigated foreign experience of regulation of the real rights adaptation (in particular, experience of Germany, the USA, Canada) and also UNCITRAL materials. Results: It is proved the solving a problem by regulation of recognition and definition of the content of the foreign security right for movable property when moving property on the Russian Federation territory. Conclusions: The research results and original problem judgment are allowed to establish the following: Application of a conflict binding of lex rei sitae in a context of creation and implementation of providing obligations is connected to certain difficulties in case of movement of the burdened personal estate abroad. The specified difficulties first of all are connected with need of recognition of providing abroad action. Situations when the "imported" security right won't admit the new location of a thing are as a result probable. The another problems are connected with definition of the legal nature of the security right, definition of its contents and its implementation. There is a need of its adaptation to new legal system in case of recognition of the security right abroad. There is made the conclusion about the need of the comparative and legal analysis of the "imported" right. The key purpose of this search is finding of the closest equivalent by the nature, form and economic target in accepting actual legal system.
