Abstract:
The need to write this article due to the needs of the analysis of legal norms regulating the migration processes in Russia and the gaps that the legislation will have to solve in the near future. Methodological basis of research are General scientific dialectic method and its private-scientific methods of cognition, such as logic, formal legal system. Theoretical basis of research is the views and conclusions contained in the works of Russian and foreign scientists: A. S. Ivanova, V. V. Grebennikova, O. S. Kapinus, N. M. Korshunova, V. F. Kozlov, A. S. Luk'yanova, A. N. Sanduga, O. D. Tretyakova, N. N. Telesino, Yastrebova A. Yu. and others. The article discusses the legislation ο migration in Russia which is comprehensive, as it refers to the private-public sphere, the experience of Western European countries, which were unprepared for migration flow, which was triggered by the war in the Middle East in 2014. Assesses the codification of legislation about migration as a means of mediating the convergence law. At the moment, the legal norms regulating migration processes in Russia are scattered in different legal acts sometimes contradict each other. The study authors concluded that to streamline legislation, to ensure its internal consistency and compactness, freedom from outdated, broken rules and offered in the future to allocate migration law as a separate branch of the Russian legislation in view of the special nature of the subject and method of legal regulation. Has been restated in the article the results of research seem to be unable to Orient legislators on early adoption in the future, important decisions associated with the codification of migration legislation as a means of mediating the convergence law.
