Abstract:
The article is devoted to the comparative legal analysis of the USA' legislation in terms of the special regime of «substantive consolidation» of the debtor's assets in the framework of insolvency of corporate groups. The article discusses the tendencies of legal regulation of protection of creditors' rights and interests taking into account the continuing characteristics of the USA' bankruptcy law. The author formulates conclusions about the positive result for creditors of the use of «substantive consolidation» in terms of the fair distribution of the debtor's assets.
