Abstract:

The purpose of the article is to cover issues related to the possibilities and problems of protecting the rights of citizens in the field of environmental protection using the monitoring mechanism provided for in the Convention on the Protection of Human Rights and Fundamental Freedoms in the context of its Article 8. To achieve this goal, it was necessary to use dialectical, logical, formal-legal and a number of other methods of cognition, while observing the whole system approach. The article reveals the content of the main provisions developed in the practice of the European Court of Human Rights with respect to environmental rights in the context of protecting the right to respect for private and family life, the permissible grounds for state intervention in the implementation of the rights under consideration. The conclusions obtained as a result of the study develop and supplement the sections of international and European law devoted to the protection of human rights. They can be used in legal practice, in the teaching process.
