Abstract:
The reason for writing this article was the inclusion in Art. 264 of the Criminal Code of the Russian Federation of aggravating factors related to person’s intoxication who violated traffic rules and exploitation of vehicles. The methodological basis of the work is the dialectical method of scientific knowledge, as well as the following special methods: logical, systematic, dogmatic and comparative legal. Recommendations expressed in this article on the use of criminal law in connection with the controversial issues of construction of aggravating factors in the criminal law provided by clauses 2, 4, 6 of Art. 264 of the Criminal Code of the RF are aimed at overcoming the existing difficulties in the criminal law assessment of factors, differentiating criminal responsibility for the specified criminal act. The opportunities of further use of the results of scientific work are seen whether the author and the scientific community will continue to work on researching and improvement of the legal structures of qualifying factors of Art. 264 of the Criminal Code of the RF. The practical value is in the expressed recommendations on the right qualifications of aggravating circumstances of Art. 264 of the Criminal Code of the RF with the aim of a uniformed interpretation and using it in law enforcement process. The originality of the work is defined by a systematic approach to the consideration and solution of the problem of constructing of qualifying factors provided by clauses 2, 4, 6 of Art. 264 of the Criminal Code of the RF. This article is focused on the law schools staff, post-graduate students, applicants and students interested in criminal law, as well as enforcement officers, prosecutors and judges.
