Abstract:
The article is devoted to the consideration of disputes by the courts on the rights of the child. Declaration of the rights of the child indicates that the child needs special safeguards and care. Among the important issues that need analysis and resolution, should, in particular, relate the definition of the place of residence of the child when the parents live apart, the exercise of the rights of the noncustodial parent, the determination of the order of detention of children, minimum amount of maintenance to be recovered for the child, etc. set forth in article provisions develop ideas about the rights of the child; allow you to resolve a number of theoretical problems arising in the implementation of his rights. The article concludes that the outlined problems are of both legislative and law enforcement nature. Proposed changes to existing legislation.
