Granting subsidies to business units: problems of legal regulation

Task: The task specified in the article is to regard peculiarities of legal regulation of an institute on granting subsidies to legal entities, sole proprietors and private persons in budget law as one of business units state support forms, and to reveal and analyze some problems of practice on law enforcement arising upon legal regulation establishment in the specified sphere at the level of the subject of the Russian Federation, and to offer methods of their solution. Model: This investigation object is public relations arising in relation to subsidies granting to business units. The investigation subject is substantive law norms regulating issues on budget relations. Theoretical and methodological base of the investigation is general scientific methods of obtaining knowledge: logical, systematic, comparative. During the investigation were used methods of comparative-legal analysis from private-scientific methods. Conclusion: According to the investigation results, the author comes to the conclusion that current system of legal regulation relations developed in connection with subsidies granting to business units does not allow putting into practice a principal of budget funds effective usage established by the Budget Code of the Russian Federation, because existing discrepancies in legal regulation admit such a situation when budget system funds of the Russian Federation can be submitted to persons who do not require legal demands, and thus, do not have any right to it. Practical meaning: Methods of solving the revealed legal regulation problems proposed during the investigation can be used by the federal legislator for developing quality of budget legal relations regulation in the purposes of increasing effectiveness of budget funds use from the budget system of the Russian Federation. Originality: In view of novelty of the problems specified in the investigation, there are no work to this theme, because a short period of time has passed from the moment when Order No.887 from September 6th, 2016 regulating issues of legal regulation establishment peculiarities in the sphere of subsidies granting to business units was admitted by the Government of the Russian Federation. This work is appointed for a legislator in the purpose of organization work on elimination of contradictions in legal regulation in the investigated sphere as well as for an executor of law for guidance in work.
