RESPONSIBILITY FOR MURDER OF THE MOTHER OF A NEWBORN CHILD: QUESTIONS OF THEORY AND PRACTICE

Objectives: on the basis of studying the provisions of the criminal legal doctrine, the current legislation and practice of its application in cases of crimes provided for in Article 106 of the Criminal Code of the Russian Federation, to determine the features of the constituent features of the investigative privileged composition of the murder, and to identify the qualifying errors that arise in establishing them. Methods: the use of dialectical, historical, comparative, formal-legal, criminal-statistical methods allowed to analyze the main categories and concepts used to implement the correct qualification of killing the mother of a newborn child. Conclusions: the article notes the need for a proper qualification to carry out a more detailed study of the circumstances determined by the legislator as reducing the risk of killing a newborn child committed by his mother. The paper substantiates the proposal on the legislative regulation of the responsibility of the surrogate mother under Article 106 of the Criminal Code of the Russian Federation, as well as on the criminalization within the framework of a qualified composition of acts committed against several victims. The suggestions and recommendations formulated by the author are aimed at improving the legislative and law enforcement approaches. Meaning: the provisions of scientific research, reflected in the article, can be used in the teaching of criminal discipline disciplines, as well as by persons who carry out the criminal legal qualification of crimes.
