Abstract:
The Constitution of 1888 was the first Constitutional Act of the independent Kingdom of Serbia. It was the adoption of the Constitution of 1888 that marked the beginning of the era of parliamentarism in Serbia. According to the majority of modern constitutionalists, the Constitution of Serbia of 1888 is one of the most advanced constitutions for the entire period of the development of Serbian constitutionalism. The Constitution was based on liberal understanding of human rights, which found its legal expression in Western European constitutions in the early nineteenth century. At the same time, the Constitution of 1888 is distinguished by a wide catalog of rights, and guarantees for their implementation. The Institute of Human Rights and Liberties under the Constitution of 1888 is the subject of this article.
