QUALIFICATION OF CRIMINAL CONTAMINATION OF VENEREAL ILLNESS: SEPARATE PROBLEMS OF THE THEORY AND PRACTICE

The article is devoted to consideration of specific problems in qualifying criminal venereal disease. The author gives the analysis of the points of view of scientists on the issue of understanding the term "infection", which is used by the legislator to describe acts as the sign of the objective side of the crime under consideration, the author offers a definition of the indicated definitions. Explores the question of criminal-legal assessment of ordaining to the risk of infection with venereal disease. Theoretical reasoning is confirmed by examples from contemporary judicial practice. The author makes a proposal for uniform understanding of the criminal code of the Russian Federation in the application of norms of the criminal contamination of dangerous infections adopt a corresponding resolution of the Plenum of the Supreme Court of the Russian Federation, which has detailed clarification on the issues that cause difficulties in the application of the law.
