THE COMPENSATION OF THE MORAL DAMAGE AS A WAY OF PROTECTION OF THE CIVIL RIGHTS IN THE SPHERE OF BIOTECHNOLOGIES

In the following article the author explores the compensation of the moral damage as one of the ways of protection of the civil rights in the sphere of biotechnologies, by actual civil legislation of Russian Federation. The author proves that the compensation of the moral damage is the only way of protection of the civil rights, which can be called the especial, concerned to the sphere of biotechnologies. There were two main arguments, which led the author to this conclusion: on the one hand, biotechnologies is a very young branch of the law, and, on the other hand, these technologies, at the present time, are useful in the medical sphere, serving to protect person’s health. Also the author gives an answer to the question about the size of the compensation of the moral damage in exploring sphere. It is necessary, considers the author, to create the scale of minimal sizes of this kind of compensation, depending of the weight of the violation of the concrete subjective civil right. In this case, the size of the compensation of the moral damage in the sphere of biotechnologies must be situated on the top of the “pyramid of minimal sizes of the compensation”.
