Abstract:
This article considers the problem of determining the boundaries of legality purchases from a single source of autonomous institutions. With the adoption and entry into force of the Federal Law "On placing orders for goods, works and services for state and municipal needs" it became clear that its content leaves open many questions, of which one of the most important is the question about the possibility of purchasing from a single supplier. On the pages of scientific publications continues active controversy, which concerns the definition of such a purchase, and the reasons, conditions and restrictions related to such purchases. In the article the author aims to solve the problem of under existing currently in procurement regulations autonomous institutions determine a single supplier procurement requirements of the procurement of goods, works and services certain types of legal entities. To solve this problem, the author used methods of statistical analysis, abstraction and Comparative Law. Analyzed cases of direct procurement largest customers - autonomous institutions (for example, the texts of the provisions of the procurement of federal universities). Identified and justified their pattern formation depending on the existing regulatory acts of the Russian Federation, as well as the statutory goals of a stand-alone institution. It is shown that in the current legislation eliminating the need to harmonize such purchases with the competent authority and securing all cases the possibility of applying this procedure, the legislator did not include the text of the law is quite clear criteria. The absence of such clarity in the criteria leads to considerable difficulties in the practical application of existing legislation, which, in turn, requires its improvement through changes and additions. Based on the analysis defines the direct purchase, formulated its main features. The novelty of the author's research, presented in this article, is seen in the extension of the original concrete proposals for action into account the principles of procurement law in the formation of a new definition for its compliance with the above-mentioned law. Among the possible social impact accounting legislator in the development and adoption of normative legal acts of the proposals submitted by the author sees a significant reduction in the severity of the problems of competition based on contradictions between government and business. Analysis itself, obtained by the author and the conclusions he proposed approaches can be the subject of further scientific discussions and become part of the Russian legal doctrine.
