Abstract:
The article considers the problem of realization of rights for the purchase of one land plot which is state or municipal property, the ownership of two (three or more) of subjects in cases when this right belongs to the owner of the property located on the land plot and land user - the owner of the right of permanent perpetual use The subject of analysis are current legislation governing the acquisition of land in state or municipal property, the owners of affected buildings, structures and the holders of the right of permanent perpetual use, and also the law enforcement (judicial) practice. It is concluded that, despite the current judicial practice, the approach to resolving such disputes, there is a conflict of rights for the purchase of land by specified persons, and priority of respective rights for the purchase of land requires a legislative solution.
