JOINT WITNESS FOR SPOUNDS IN THE INTERNATIONAL PRIVATE LAW OF THE RUSSIAN FEDERATION

The topic considered in the article is extremely topical for today, since in the scientific literature disputes are being made regarding innovations in the Civil Code of the Russian Federation in the section of inheritance. The article deals with the institution of joint wills of spouses, its origin and development in Russian private international law. The emergence of this institution is directly related to the desire of the legislator to significantly expand the regulation of hereditary relations, while using the new legal institutions. This proposal was also partly related to the accession to the Russian Federation of the Republic of Crimea and the city of federal significance of Sevastopol, whose legislation had previously established the institution of a joint will of spouses. We believe that the introduction of this institution, in the form in which it was proposed in the draft law to date, is impossible. The bill should undergo significant changes to eliminate legal gaps that may arise in practice.
