On special criminal units counteraction problem

The article deals with the main problems of qualifying the crimes provided for in articles 205.4 ("Organization of a terrorist community and participation in it"), 205.5 ("Organization of the activity of a terrorist organization and participation in the activities of such an organization"), 208 ("Organization of an illegal armed group or participation in it"), 209 ("Banditry"), 210 ("Organization of a criminal association (criminal organization) or participation therein"), 282.1 ("Organization of an extremist community"), 282.2 ("Organization of the activities of an extremist organization"), 239 ("Creation of a non-profit organization that encroaches on the individual and the rights of citizens") of the Criminal Code of the Russian Federation. Among the problems under consideration are questions, definitions of the moment of legal termination and actual cessation of socially dangerous acts enshrined in the dispositions of these criminal law norms; questions of determining a possible set of analyzed norms; as well as the issues of correlating each of the special criminal associations with the types of criminal groups enshrined in Art. 35 of the Criminal Code. The author also suggests ways to improve criminal legislation in the field of countering special criminal associations.
