Abstract:
The article is focusing on the current problem regarding verification and optimization of the power of the prosecutor to control procedural activity of the preliminary investigation bodies. In the prosecutor supervision practice there has been a traditional procedure for responding to the revealed violations in the area of ​​criminal procedures that is to represent a petition. However this power of the prosecutor has not received legislated change of the Criminal Procedure Code to correct and mitigate the procedures causing problematic situations. The following study formulates the proposals to improve the active legislation; it is based on the analysis of the scientists’ opinions, the examples of established practice in applying the law, the prosecutor's office’s statistics, as well as on the results of the survey of prosecutors in various regions of Russia conducted by the author. The conclusions and proposals presented in the study can be used in practices by the law enforcement authorities, as well as in preparing topical scientific and methodical studies. The author’s proposals’ implementation upon capturing in the Criminal Procedure Code of the Russian Federation the prosecutor right to make a submission to eliminate the law violations will allow to apply effectively and complex-valued the system of powers to oversee the procedural activity of the preliminary investigation bodies as a whole, and thus will help to strengthen the mechanism of warrantee of the participants’ rights in criminal proceedings.
