The purpose of writing of article was consideration legal problem transplantation of bodies and tissues of the person in Russia and foreign countries. Research area - the detection of features of the legislation on an organ transplantation and tissues of the person concerning criminal violations of health workers in this sphere (on the example of the legislation of Germany, Ukraine and Kyrgyzstan). Need of introduction to the current version ch.2st.102 by the criminal code of Russian Federation of definition of the special subject - the health worker is revealed and proved. On the basis of legal researches by the author it is offered to regulate registration of withdrawal of biomaterial at a corpse the special act, at obligatory existence of permission of bodies of prosecutor's office to commission of actions for an intake of materials. Article is oriinalny, contains the analysis of the modern legislation on transplantation not only Russia, but also foreign countries.
