Abstract:
The article dwells on the analysis of the presumed consent model, which steers the legal regulation of human organs and tissues donation in the Russian Federation. Problems caused by this model and some other imperfections of the legal regulation are revealed. The article points out some of the lacunae of the legal regulation and its inconsistency in the light of the idea according to which a maximum possible quantity of organs and tissues should be made possible to be donated. The analysis of foreign legislation is carried out as a more successful approach to some of the transplantation-related issues.
