Abstract:
Objective: Analysis of the conditions adopted in the sanctions policy of special economic measures and enforcement of the Supreme Court of the Russian Federation on a legal assessment of these measures. Questions of economic security, including aspects of sanctions at the international level, considering various scholars, both domestic (L. Abalkin, S. Maximov, O. Safonov) and foreign (N. Rouiller, G.K. Hafbauer , J.J. Schott), but consideration of the economic security issues in relation to the judicial practice remains poorly understood. Model: The work is based on the general scientific research methods (analysis, synthesis, deduction, analogy, modeling, abstracting). It is also the basis for the methodology constituted the dialectical method and the associated public-scientific methods: normative-legal technique, the method of analysis of legislation and practice, formal-logical method of interpretation of the law. Conclusions: Based on the analysis of judicial practice, the problems balance of interests of the individual, society and state in the context of economic security, including financial penalties. It is noted the recognition by the courts of special measures aimed at ensuring economic security, lawful and justified on the basis of the fact that the power to adopt such measures legally defined and within the exclusive knowledge of specific authorities. Originality: Theoretical and practical significance is reflected in the further formation and theoretical basis of economic security and development of manifestations in its security measures in the law-making and law-enforcement practice.
