Criminal and legal counteraction to a misuse of insider information

Challenge: In article the analysis of structure of the crime provided by Art. 185 is made. 6 Criminal codes of the Russian Federation (misuse of insider information). Model: Difficulties and problems in criminal prosecution, investigation by law enforcement agencies of the criminal cases connected with a misuse of insider information. The detailed analysis of object, the objective party, the subject and the subjective party of structure of the crime provided by Art. 185.6 of the Criminal code of the Russian Federation and offers on interpretation of the above rule of law. Conclusions (results): Insider activity undermines the market principles of honest competitiveness. Unequal position of participants of the market in number of information known for it leads to losses at owners of securities, it destroys business reputation of the companies, and in vast scales - national stock markets as a whole, can lead to destabilization of the economic relations, both on micro, and at macrolevel. Originality/value: this work is intended for the persons dealing with issues in the sphere of the financial market, and also businessmen who wish to protect the business from a misuse of insider information.
