Current trends in the use of information and telecommunications network in the process of committing a crime

The task - Research of this problem is of interest for dissertation research. The purpose is research of a role and value of information and telecommunication networks at commission of crime. The model - Methodology of this scientific article consists in the analysis of theoretical provisions, provisions of judicial and investigative practice and interpretative acts. On the basis of analogy the conclusion is drawn on need of inclusion of such circumstance as the committed crime aggravating fault with use of mass media or information and telecommunication networks. Such method as comparison of theoretical provisions, and also explanations of the highest judicial authorities in questions of application of the criminal legislation is used. Conclusions - In our opinion, the legislator goes on the way of gradual entering into many standards of the criminal code of Russian Federation of a sign of corpus delicti, as commission of crime with use of mass media or information and telecommunication networks. We offer will add Art. 63 of the criminal code of Russian Federation with such circumstance aggravating fault, as made with use of mass media or information and telecommunication networks. Research framework - Further specification of this problem will be reflected in dissertation research. The following steps - studying of a role and value of information and telecommunication networks in the course of commission of crime and degree of their public danger. Practical value - possibility of preparation of methodical recommendations about qualification of crimes with use of information and telecommunication networks. Originality/value - In this work value and a role of mass media or information and telecommunication networks in the course of commission of crimes is studied, the question of their degree of public danger is brought up, the main ways of improvement of practice of application and the legislation are defined. This article will be useful to students, graduate students and scientists, the fond actual problems of criminal law.
