Application of the constitutional principles of local selfgovernment by the Russian courts

Purpose: to carry out the analysis of practice of application by courts of law and the Constitutional Court of the Russian Federation of constitutional principles of local self-government. Methods: methods of the analysis, deduction and also legallistic, system and structural methods of scientific knowledge are used. Results: the analysis of practice of application by general jurisdiction courts and the Constitutional Court of the Russian Federation of the constitutional principles of local self-government is carried out, insufficiency of application by courts of law of the studied principles and efficiency of use of the constitutional principles at settlement of disputes by the Constitutional Court of the Russian Federation is revealed, the proposal is made courts of law for permission of conflict situations in the sphere of local government to use the constitutional principles of local government as basis of the status of local government. Scientific novelty: the author has made assessment of systematicity of application of the constitutional principles of local government by general jurisdiction courts and the Constitutional Court of the Russian Federation and also concrete examples of emergence of collisions of all-legal principles and constitutional principles of local self-government on settlement of disputes in the sphere of functioning of local government are given. Article is intended for the persons researching institute of self-local government in the Russian Federation and also can be interesting to scientists-jurists, judges and other practicing lawyers, teachers and students of legal higher education institutions. Practical importance: results can be used in law-making and law-enforcement activity of the courts in the Russian Federation, public authorities of the Russian Federation and subjects of the Russian Federation, municipal authorities and also in educational process when teaching disciplines "Constitutional law ", "The municipal law " and others.
