Abstract:
The purpose of the study is based on legal, legal and empirical sources of legal analysis of the features of the division of the general obligations of the spouses, which in modern Russia is relevant, because in the existing socio-economic conditions, the institutions of the obligation law are of particular importance. The methodological basis was the dialectical method of scientific cognition as the basic method of objective and all-round cognition, as well as general scientific methods of cognition and private scientific methods of cognition. As a result of the study, the concept of "the general obligation of the spouses" and its relation to the concept of "common property of spouses" were analyzed. Legal problems of sharing common obligations of spouses are revealed, and ways of their solution are suggested. The practical importance of the research is expressed in the fact that the proposals formulated in the work can be taken into account in the judicial and other law enforcement practices, as well as in the process of improving the legal regulation of the obligation relations with the participation of persons who are married.
