Abstract:
The relevance of the article is conditioned by the need to study the abuse of powers - as a negative social phenomenon in the state and its signs for the most effective struggle against official and corruption crime. The purpose of the article is to consider existing scientific approaches to the definition of the concept of "abuse of power", as well as its constituent features. Realization of the set tasks was achieved with the help of general scientific (dialectical, analysis, synthesis) and private-science methods (formal-legal, comparative-legal). The author concludes that the abuse of power is an illegal act, to which a number of signs are inherent: wrongfulness, guilt, public danger. Abuse of power is a form of abuse of power, powers can be represented as rights and obligations established by law. This is the process of the person's exercise of subjective rights.
