Abstract:
The article covers new legal norms regulating the labour of workers under temporarily seconded by the employer to other private individuals or legal entities under secondment agreements, which were introduced into the Labour Code of Russia by the Federal Law as of 05/05/2014 # 116-FZ. The author, by using a systematic-structural method of scientific researches delves into the topic of distribution of responsibility between the formal employer (a private employment agency) and the actual employer (the receiving party, the user-organization). The conclusion points out the necessity for maintaining records of the content of the relations between all parties involved in the process of using provided labor. Several works of not only domestic legal scholars, but foreign authors as well have been dedicated to separate aspects of the article's topic (e.g. Schiek D. Agency Work - from Marginalization towards Acceptance? Agency work in EU Social and Employment Policy and the «implementation» of the draft Directive on Agency work into German law // German law Journal. 2004. Vol. 5. No 10). The author's views, outlined in the article, may be used for further studies of legal regulation of relations, arising out of contract-agency labor use, and may also be used during development of specific means aimed at perfecting the legislation in this sphere.
