Abstract:
In the present article deals with the interpretation of such valuation categories of art. 125 of the Criminal Code as dangerous to life and health condition of a person and knowingly leaving without help, questions of interpretation are revealed by the authors from the perspective of the theory of criminal law, in addition to the specific example of judicial decisions the authors focus on the controversial moments of qualification on the grounds of "abandonment in danger" in particular, it is a specification of the threat of possible damage to health, which may be covered by Art. 125 of the Criminal Code, qualification, if dangerous to life and health condition of the victim was the result of intentional actions (or inaction), for which the law establishes criminal liability, as well as questions of qualification if dangerous to life and health condition of the victim was the result of careless actions (or inaction) on the example of Art. 264 of the Criminal Code "Violation of traffic rules and operation of vehicles."
