THE CHIEF OF THE INQUIRY BODY AS A PARTICIPANT IN THE CRIMINAL PROCESS

In article the concept and specified the powers of the chief of the inquiry body. It is noted that in part 2 of article 40.2 of the code of criminal procedure procedural-legal position of the chief of body of inquiry specified, the legislator indicated that in relation to the interrogators, he implements the powers of the chief of division of inquiry, that is, the chief of body of inquiry does not exercise procedural control over investigation proceedings, it is left for the Prosecutor, but performs the procedure of departmental control over the activities of investigators. Analyzed the procedural position and powers of the chief of body of inquiry, focuses on the nature of the relationship between the chief of the inquiry body and the head of Department, as the CPC their relationships are determined indirectly through other rules. Provided that in criminal proceedings the relations between the participants are only legal in nature, they are clearly regulated by the norms of the code, so the relationship between these entities should only have criminal procedural character.
