Fraud in the insurance industry in the context of the criminal legislation’s reform of the Russian Federation

The Article is devoted to the criminal-legal analysis of fraud in the insurance industry. The necessity and expediency of the introduction into the criminal code the offence criminalizing insurance fraud in Russian Federation. Comparative legal analysis of the crimes provided by articles 159 and 159.5 of the Criminal code of the Russian Federation. The article disclosed the content of the elements of the offence provided for article 159.5 of the Criminal code of Russia: the subject of crime, methods of attack, and other more subjective than objective and elements and signs of fraud in the insurance industry. Analyzed the legal and literary sources of information and materials of judicial practice in cases of fraud in the insurance industry. The author of the idea about the necessity to invest in existing revision by article 159.5 of the Criminal code of the Russian Federation the changes in order to improve the efficiency of its implementation the law enforcement agencies and optimize its disposition for a more precise qualification of the committed crime in the area of insurance.
