CRIMINAL BANKRUPTCY AS ONE OF THE SECTORS OF THE SHADOW ECONOMY

Objectives: the Purpose of this article was to study criminal bankruptcy as one of the sectors of the shadow economy, as well as to establish gaps in the Russian legislation in the field of combating criminal bankruptcy. Methods: the use of comparative and historical methods contributed to the study of normative legal acts that were in force during the post-socialist Russia in the 90-ies and now. On the basis of comparison of provisions of regulatory legal acts the author reveals similarities and distinctive features of bankruptcy procedures, their content and General orientation, which allowed to establish the prerequisites for committing crimes in the field of criminal bankruptcy. Conclusions: the Article is devoted to the study of the features of counteracting the shadow economy in the field of criminal bankruptcy. The scientific study proves that criminal bankruptcy is one of the sectors of the shadow economy. The author comes to the conclusion that in order to ensure economic security of Russia requires a systematic improvement of the legislation in terms of creating effective regulatory legal framework to counter criminal bankruptcy. Meaning: the Article may be useful for readers interested in issues of combating criminal bankruptcy. It is expected that the provisions of the research will contribute to the improvement of legal regulation of the shadow economy.
