Abstract:
The article presents the position of a number of scientists who deny the necessity of dividing the law to private law and public law or criticizing of its multiplication value. Particular attention is given to the review of the classic theories of dualism formed in the pre-revolutionary civil law of the Russian Empire, which are combined into two schools - the "material concept" and "formal-legal concept." As a result, the author concludes that the effect of flatness of some of them, or for other reasons, none of the presented theories can not claim its unconditional recognition of the legal doctrine. The same criteria as the division of the law to private and public the article proposes to use some of them at the same time: to use the category "interest", as well as the specifics of the relations regulated by this or that branch of the law, taking into account the presence or absence of relations of subordination.
