Abstract:
The task: the article analyzes the situation on the application of art. 306 of the Criminal Code. "A deliberately false denunciation" to counter the roll of false statements about crimes that enter the penal system. The issues of investigation and necessary actions of a member of the Federal Penitentiary Service of the Russian Federation are examined in the course of revealing deliberately false information about crimes in appeals. Methodology: formal legal and comparative legal methods were used. Conclusions: a mechanism has been formulated for determining the investigative jurisdiction in criminal cases of this category and an algorithm for the actions of a member of the Federal Penitentiary Service of Russia has been developed in the detection of knowingly false information about crimes in appeals. The scope of the study / the possibility of subsequent use of the results of scientific work: certain provisions of the work that disclose the contentious issues of the qualification of the study composition and the specifics of its application in the institutions of the penal system. Practical significance: the proposals formulated in the article can be used by the law enforcement agencies for appropriate actions to change the current situation and activities related to the publication of intradepartmental normative acts. Social consequences: the article is of interest for further improvement of criminal law and law enforcement practice.
