Abstract:
The article deals with the term "close relatives" in criminal procedural context. The circle of persons related to close relatives is investigated. The necessity of excluding from the circle of persons belonging to close relatives according to the Russian Federation Code of Criminal Procedure is proved, as kinship and matrimony are unequal concepts. Spouses are not close relatives, since marriage in the Russian Federation is possible only in the absence of close kinship between citizens. It is suggested to take into consideration matrimonial relations autonomously in legal norms, to develop a unified content of the term "close relatives."
