Abstract:
The article discusses the issue of the right of the court at the request of the creditor to adjudge in his favor a sum of money in case of default of the judicial act on the compulsion to fulfill obligations in kind. The author analyzes the explanation of the Russian Supreme Court on the substantive judicial penalties as Institute of civil law and refers to the challenges facing civil legal science in connection with the addition of civil law a new way of protection of the rights of the creditor on the obligation.
