Abstract:
In this research the author examines general theoretical ideas of determining legal gaps and the possibility of using legal presumptions as a means of determining gaps. The author draws a conclusion that determination of legal gaps is a key part of resolving the issues of overcoming and eliminating them. According to the author, although determination is usually part of law enforcement activity, it also has great significance for the process of law-making. Regarding methods of determining legal gaps, the author mentions that legal presumptions are part of the formal legal method of determining gaps. Taking into account that the result of determining a gap can be both positive (presence of gap) and negative (lack of gap), the author makes a conclusion that legal presumptions are not an effective means of determining gaps in the positive sense, but may serve to negate the presence of legal gaps. The author believes that social presumptions, which are part of the specific sociological method of determination, may be used as means of determining gaps.
