Abstract:
This article discusses the important problems of public law regulation of bankruptcy of citizens, the presence of which indicates the lack of research topics and the need for a thorough scientific analysis of the whole complex of problems of the law Institute. The purpose of this article is to study the current problems of public law regulation of relations in the field of bankruptcy of citizens. Special attention is paid to the improvement of public legal regulation of legal relations in the field of bankruptcy. As a result, it was revealed that effective financial recovery of a citizen is possible under such conditions as timely start of rehabilitation; the debtor's assets should be assessed realistically; effective legal regulation should be in place to prevent abuse of the right by debtors and creditors; the procedure for satisfaction of creditors ' claims should the debtor be insolvent.
